General Terms and Conditions (GTC) for Coach K Personal Coaching//KS Marketing Sales

§1 Scope

These General Terms and Conditions (GTC) apply to all contracts for services between Coach K Personal Coaching, represented by Konstantin Straßel, and the customer, unless otherwise agreed. Coach K Personal Coaching offers coaching services in the areas of fitness, nutrition, professional development, and financial planning (work-life balance).

§2 Contract conclusion

  1. The contract for coaching services is concluded when the customer books a free initial consultation and the contract is subsequently signed by both parties.
  2. The initial consultation serves to determine the client's goals and needs and is non-binding and free of charge.

§3 Scope of services

  1. Coach K Personal Coaching offers customized coaching services tailored to the individual needs of each client.
  2. Services include: creation of fitness and nutrition plans, financial planning (no specific investment advice and/or recommendations), professional development, and financial planning (work-life balance).
  3. The customer receives regular feedback meetings and ongoing support via WhatsApp, Zoom, telephone, or alternative communication methods.

§4 Contract term and termination

  1. The contract is concluded for an indefinite period, begins on the agreed start date, and has a minimum term of 3 months.
  2. After the minimum term has expired, the contract may be terminated by either party at any time with one month's notice to the end of the month.
  3. The right to terminate for good cause remains unaffected.

§5 Remuneration

  1. Unless otherwise agreed, the monthly fee for coaching services is €199 per month.
  2. Remuneration is payable monthly in advance.
  3. In rare cases, Coach K offers personal coaching with individual consultations and fees. Prices for this service are agreed upon individually.

§6 Liability

  1. Coach K Personal Coaching is only liable for damages resulting from intentional or grossly negligent breach of duty.
  2. The support is provided carefully and conscientiously. However, Coach K Personal Coaching does not have detailed knowledge of the customer's state of health, mental and physical condition, or resilience.The customer therefore carries out the training sessions on their own responsibility. Coach K Personal Coaching accepts no liability for damage to health that occurs during training, unless this is due to gross negligence.

§7 Use of apps and devices

  1. Coach K Personal Coaching recommends the use of certain apps and devices to optimize coaching results. The use of these apps and devices is optional and may incur additional costs.
  2. Coach K Personal Coaching is open to the use of all common apps, systems, trackers, and devices and supports customers during the familiarization process.

§8 Data protection

  1. Coach K Personal Coaching processes the customer's personal data exclusively for the purpose of fulfilling its contractual obligations.
  2. Further information on data protection can be found in the privacy policy on the Coach K Personal Coaching website.

§9 Severability clause

  1. Should individual provisions of these General Terms and Conditions be invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid provision that comes closest to the economic purpose of the invalid provision.

§10 Applicable law

  1. The law of the Federal Republic of Germany applies. The place of jurisdiction is the registered office of Coach K Personal Coaching, Schwaebisch Hall, GERMANY.
